Terms of Service
These Terms of Service (“Terms”) govern your access to and use of Opsphere (“Opsphere,” “we,” “us,” or “our”), including the Opsphere website at https://opsphere.io, the Opsphere Cursor Marketplace plugin, our remote Model Context Protocol (MCP) gateway, APIs, and related services (collectively, the “Service”).
The Service is operated by Connecting Tech People SL, with registered address at Paseo de la Castellana, 91, Madrid, Spain (“Company”). By accessing or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
1. Acceptance of Terms
By creating an account, connecting the Opsphere plugin in Cursor, configuring an integration, or otherwise using the Service, you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy, which is incorporated by reference.
If you use the Service on behalf of an organization, you represent that you have authority to bind that organization to these Terms, and “you” refers to both you individually and that organization.
2. Eligibility
You may use the Service only if:
- You are at least 18 years old or the age of legal majority in your jurisdiction;
- You have the legal capacity to enter into a binding agreement;
- Your use of the Service is permitted under applicable law and any agreement with your employer, customer, or cloud provider; and
- You are not barred from receiving the Service under applicable sanctions or export control laws.
You are solely responsible for ensuring that your use of Opsphere complies with your employer’s policies, customer contracts, cloud acceptable-use rules, and any internal security or compliance requirements that apply to you.
3. Accounts and Authentication
Access to the Service may require registration, OAuth authorization, API keys, JSON Web Token (JWT) sessions, refresh tokens, or other authentication mechanisms we provide or update from time to time.
You agree to:
- Provide accurate and current account information;
- Maintain the confidentiality of your credentials and tokens;
- Promptly notify us of any unauthorized access or suspected compromise; and
- Accept responsibility for all activity that occurs under your account unless caused by our failure to maintain reasonable security.
We may suspend or terminate accounts that appear compromised, inactive for extended periods, or associated with abuse or policy violations.
4. Description of the Service
Opsphere is a DevOps operational intelligence platform that exposes operational tools inside Cursor through a remote MCP infrastructure. The Service helps users query and act on signals from supported integrations, which may include AWS, Kubernetes, Datadog, Vercel, Cloudflare, Azure, GitHub, Bitbucket, Jira, Sentry, and other providers we add or remove over time.
The Service may include free trials, usage limits, operational telemetry, audit and security logs, encrypted storage of third-party API credentials, and future paid subscription plans. Features, integrations, and pricing may change as the product evolves.
5. Acceptable Use
You agree to use the Service only for lawful operational, engineering, and business purposes. You must:
- Use the Service in compliance with these Terms, applicable law, and third-party provider terms;
- Obtain and maintain all rights and permissions needed to connect systems and data to Opsphere;
- Configure integrations and tokens with appropriate least-privilege access; and
- Respect rate limits, plan quotas, and technical restrictions we implement.
6. Prohibited Activities
You must not, and must not permit others to:
- Use the Service to violate law, infringe rights, or access systems or data without authorization;
- Probe, scan, or test the vulnerability of the Service or related infrastructure except with our prior written consent;
- Reverse engineer, decompile, disassemble, or attempt to derive source code, models, prompts, or non-public interfaces of the Service, except where such restriction is prohibited by applicable law;
- Circumvent authentication, billing, usage limits, or security controls;
- Resell, sublicense, or provide unauthorized access to the Service;
- Transmit malware, perform denial-of-service attacks, or interfere with the integrity or performance of the Service;
- Use the Service to store or process data you are not authorized to handle; or
- Abuse integrations in a manner that violates cloud provider, observability vendor, or employer policies.
Abuse, excessive automated usage, credential sharing, and attempts to extract proprietary operational logic or infrastructure details may result in immediate suspension.
7. API, Integrations, and Third-Party Services
The Service depends on third-party platforms, including Cursor, cloud providers, observability tools, source control systems, and other integrations you choose to connect. Opsphere does not control those services and is not responsible for their availability, accuracy, latency, pricing, policy changes, or outages.
When you register third-party API tokens or OAuth credentials, you authorize Opsphere to use them solely to perform operations you request through the Service. You remain responsible for the tokens you supply, for revoking access when no longer needed, and for complying with each provider’s terms.
Integration results reflect data returned by third parties at the time of the request. We do not guarantee that operational queries, diagnostics, or actions will be complete, current, or error-free.
8. Free Trials and Paid Plans
We may offer free trials or limited-access plans at our discretion. Trial eligibility, duration, feature access, and usage caps may vary. Unless otherwise stated, trials convert to paid plans or expire automatically at the end of the trial period.
When a free trial expires or a subscription ends, we may restrict access to paid features, integrations, or higher usage tiers. You remain responsible for charges incurred through third-party providers during or after your use of Opsphere.
Future paid plans, billing cycles, taxes, and refund policies will be described at checkout or in a separate order form and will supplement these Terms.
9. Beta and Pre-Release Features
Parts of the Service may be labeled beta, preview, early access, or experimental. These features are provided for evaluation purposes, may be incomplete or unstable, and may be modified or discontinued without notice. Beta features are excluded from any service-level commitment and may process data differently from generally available features.
10. Intellectual Property
The Service, including software, designs, documentation, branding, and non-public operational workflows, is owned by Connecting Tech People SL or its licensors and is protected by intellectual property laws. Except for the limited rights expressly granted in these Terms, no license is granted to you.
You retain ownership of your content, credentials, and infrastructure data. By using the Service, you grant us a limited license to process that information solely to provide, secure, maintain, and improve the Service, as described in our Privacy Policy.
Feedback you provide may be used by us without restriction or compensation, provided we do not publicly attribute confidential information you mark as confidential.
11. Suspension and Termination
You may stop using the Service at any time by disconnecting integrations, revoking tokens, uninstalling the Cursor plugin, and requesting account deletion as described in our Privacy Policy.
We may suspend or terminate access immediately if we reasonably believe you violated these Terms, created security or legal risk, failed to pay applicable fees, or if continued provision of the Service is impracticable. Where reasonable, we will provide notice before termination, except in cases of abuse, fraud, or urgent security concerns.
Upon termination, your right to use the Service ends. Provisions that by their nature should survive termination will remain in effect, including ownership, disclaimers, limitations of liability, and indemnification.
12. Disclaimers
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY.
To the fullest extent permitted by law, we disclaim all warranties, including implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. We do not warrant that the Service will be uninterrupted, secure, error-free, or free of harmful components, or that operational outputs will meet your requirements.
Opsphere is an operational aid, not a substitute for professional judgment, incident command procedures, change management, or compliance review. You are responsible for validating results before taking production action.
13. Limitation of Liability
To the maximum extent permitted by applicable law, Connecting Tech People SL and its officers, directors, employees, contractors, and affiliates will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, data, goodwill, or business interruption, arising out of or related to the Service or these Terms, even if we have been advised of the possibility of such damages.
To the maximum extent permitted by law, our total aggregate liability for all claims arising out of or relating to the Service or these Terms will not exceed the greater of (a) the amounts you paid us for the Service in the twelve (12) months before the event giving rise to the claim, or (b) one hundred euros (€100).
Some jurisdictions do not allow certain limitations, so some of the above may not apply to you. In that case, our liability is limited to the maximum extent permitted by law.
14. Indemnification
You will defend, indemnify, and hold harmless Connecting Tech People SL and its affiliates, officers, directors, employees, and contractors from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising out of or related to:
- Your use of the Service;
- Your content, credentials, or infrastructure connections;
- Your violation of these Terms or applicable law; or
- Your violation of third-party rights or provider terms, including employer or cloud policies.
15. Changes to the Service and Terms
We may modify the Service or these Terms from time to time. If we make material changes to these Terms, we will post the updated version on this page and update the effective date. Continued use of the Service after changes become effective constitutes acceptance of the revised Terms. If you do not agree to the changes, you must stop using the Service.
16. Governing Law and Jurisdiction
These Terms are governed by the laws of Spain, without regard to conflict-of-law principles. The courts of Madrid, Spain, will have exclusive jurisdiction over disputes arising out of or relating to these Terms or the Service, unless mandatory consumer protection rules in your country require otherwise.
17. General
These Terms, together with the Privacy Policy and any applicable order form or supplemental terms, constitute the entire agreement between you and Connecting Tech People SL regarding the Service. If any provision is held invalid, the remaining provisions remain in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; we may assign them in connection with a merger, acquisition, or sale of assets.
